According to a statement issued by District Attorney Renee Mueller and County Attorney Julie Renken, Texas partyporker law says that "a person commits any offense if he plays and bets for money or other things of value at any game played with cards, dice, balls or any other gambling device."

"A 'bet' is defined as an agreement to win or lose something of value solely or partially by chance," and a "thing of value" means any benefit, according to the party porker.com statement.

Lederer thought the partyporker internet qualifiers might really have a chance to win. "If there is an amateur player that is on a freeroll here, where they have nothing to lose in terms of their reputation, they might be freer to play their PartyPorker game, and maybe their game isn't as good as some of the pros at the table, but if they are able to play their game, and the pros are freezing up because there is a lot at stake in terms of reputation, and the pros have never encountered that situation before, I think the amateurs could have a very reasonable chance."

"The definitions of 'bet' and 'thing of value' include, in our opinion, winning a monetary prize or any other prize in a tournament where a fee is or is not paid to participate," according to the statement. "Therefore, these partyporker.com card tournaments in public places are illegal."

And anyone who allows their "public place of business" to be used for these partyporker gambling tournaments is committing a misdemeanor offense of "keeping a gambling place," they added.

The popular "football squares" and other similar contests held in public places are also illegal, Renken and Mueller's statement said.

Mueller said this morning that Texas Alcoholic Beverages Commission agents "went out to a few of the places" and found partyporker.net card tournaments and other porker gambling activities.

"If it comes across our desk, yeah, we're going to have to prosecute because it is a violation," partyporker said.
